1. Law Society of Yukon and trust accounts
You must notify the Law Society's Executive Director in writing as soon as practicable after opening a trust account. Active members in private practice must also notify their financial year-end date and notify within 30 days if it changes. When opening an account, send a Letter of Direction to your financial institution: the account must be designated as a trust account, interest-bearing, with interest remitted to the Yukon Law Foundation, and the institution authorized to provide the Foundation with information on calculated interest. A copy of the letter must be provided to both the Law Society and the Foundation.
2. Form 18 and Form 19
Lawyers with trust accounts must file a Trust Account Report (Form 19) within six months after their financial year-end. Active members in private practice must also file a certification (Form 18) within six months of year-end. Failure to file Form 18 results in automatic suspension until the form is filed, unless an extension is granted.
3. Client identification and verification (Division 16)
Division 16 of the Law Society Rules governs books, records, and accounts. You must maintain strict record-keeping for trust accounts and comply with client identification and verification procedures, including information about the source of funds in financial transactions.
4. Privacy: PIPEDA
In Yukon, the private sector (including law firms) is subject to PIPEDA. Centralizing data in a secure environment with an audit trail supports compliance.
5. Billing: GST
